Welcome to Fraîche Studios. These Terms of Service ("Terms") apply to your use of www.fraiche-studios.com (the "Site") and to any purchase you make from us. The Site is operated by A Walk in Brooklyn, LLC d/b/a Fraîche Studios ("Fraîche Studios," "we," "us" or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order, or have permission from a parent or guardian who agrees to these Terms.

2. Products and descriptions

We do our best to show our products, colors and sizes accurately. Colors can look different from screen to screen, and because our pieces are made in small runs, small variations can occur. We don't guarantee that product descriptions or other content on the Site are free of errors. Products are available while supplies last.

3. Pricing and payment

Prices are in US dollars unless shown otherwise and can change without notice. Taxes and shipping are calculated at checkout. If a product is listed at the wrong price because of an error, we may cancel the order and refund you in full. Payment is processed securely through Shopify and our payment providers; we don't store your full card details.

4. Orders

Your order is an offer to buy. We may refuse or cancel any order, including if an item is unavailable, we spot an error, or we suspect fraud. If we cancel after you've been charged, we'll refund you in full.

5. Pre-orders

Pre-order items are charged at checkout and ship by the estimated date on the product page. Estimated dates may change. If a pre-order is delayed, you can keep waiting or cancel for a full refund.

6. Shipping

Shipping times, rates, customs and delivery responsibilities are described in our Shipping Policy, which is part of these Terms.

7. Final sale, cancellations and refunds

All sales are final. Cancellations, and what we do if an item arrives damaged, defective or wrong, are covered in our Refund Policy, which is part of these Terms.

8. Intellectual property

Everything on the Site, including the Fraîche Studios name and logo, our designs, the words and artwork on our products, product photos, graphics and text, belongs to Fraîche Studios or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, sell or use any of it without our written permission.

9. Your content

If you send us reviews, photos, comments or ideas, or tag us on social media, you give us permission to use, share and display that content in connection with our business, without payment to you. You confirm the content is yours to share and doesn't violate anyone's rights.

10. Acceptable use

You agree not to use the Site for anything unlawful; to interfere with its security or operation; to upload viruses or harmful code; to scrape or collect data from it; or to harass, impersonate or harm others.

11. Third-party links

The Site may link to other websites. We aren't responsible for their content, products or practices.

12. Privacy

How we collect and use your information is described in our Privacy Policy.

13. Disclaimer

The Site and our products are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, except as stated in our Refund Policy.

14. Limitation of liability

To the fullest extent the law allows, Fraîche Studios and its owners, employees and partners aren't liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid for the product involved.

15. Indemnification

You agree to protect and hold harmless Fraîche Studios from any claims, losses or costs (including reasonable attorneys' fees) that come from your breach of these Terms or your misuse of the Site.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site or your purchase will be handled exclusively in the state or federal courts located in Virginia, and you agree to their jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the effective date above will be updated. Continuing to use the Site after a change means you accept the updated Terms.

18. Severability

If any part of these Terms is found unenforceable, the rest stays in effect.
